Two-Year Overstay

Background

A mother entered the United States on a visitor visa in 2021 and overstayed for nearly two years. After her son naturalized, he filed for her.

Challenges

An overstay record combined with a language barrier.

Strategy

The I-130 highlighted the son's financial strength, and the I-485 handled the overstay record carefully. A Teochew interpreter was present throughout the interview, and we ran a 30-minute high-intensity mock interview. We relied on the rule that forgives overstays for immediate relatives of U.S. citizens adjusting status.

Outcome

The 30-minute interview went smoothly, and the case was approved.
