I-751 After Divorce + Combined Naturalization Interview

Background

In 2021 the client filed an I-751 (to remove conditions and move from a 2-year to a 10-year green card) without counsel and divorced the spouse while it was pending. After the I-751 received an RFE in 2023, our firm took over, and the later N-400 naturalization interview was combined with the I-751.

Challenges

After the divorce, the I-751 had to be filed individually, which carries high review risk. The N-400 triggered an additional RFE because of a stay abroad of more than 6 months. A combined interview examines both applications, doubling the difficulty.

Strategy

We thoroughly organized the evidence of the marriage and divorce so the I-751 could stand on its own as an individual filing, used legal provisions and supporting documents to explain the reasonableness of the time spent abroad, and ran multiple rounds of mock interviews for the combined interview.

Outcome

The I-751 was approved, and the client received a 10-year green card and a naturalization certificate, then married a new partner three days later (naturalized 09/17/2025 · remarried 09/20/2025).
