Two-part RFE

Self-Employment Through a Third-Party Employer Structure

Background

The client holds a bachelor's degree in journalism and business administration and a master's in sports management, and filed an H-1B on the client's own behalf through a third-party employer structure, working at a fishing tackle company.

Challenges

His EAD had expired and the F-1 grace period was counting down. After the petition was upgraded to premium processing, it received an RFE raising two issues at once: the Latin-language diploma did not meet requirements, and the position was not specialized enough. There would be no second chance to file.

Strategy

We worked with the school to obtain an officially sealed English translation to resolve the degree document issue, and argued the specialized nature of the position from four angles: the employer, an expert, the law firm, and the client.

Outcome

Approved just before the grace period ended (filed 06/25/2025 · approved 03/30/2026).
