Full validity for self-employment through a third-party employer structure
Background
The client, with a background in sociology and marketing management, started a business and was self-employed through a third-party employer structure, bringing in an outside investor to hold shares on the client's behalf to address the risk of scrutiny as a "one-person company."
Challenges
A self-employment structure can easily be treated as a one-person company, and the connection to the client's OPT also had to be traced back and argued.
Strategy
We tied the client's sociology and marketing management background closely to the Market Research Analyst position, and managed the entire process from forming the company from scratch and designing the ownership structure to planning the office space.
Outcome
After a precise RFE response, the petition was approved for the full 3 years (filed 06/27/2025 · RFE received 11/12/2025 · response filed 12/21/2025 · approved 01/23/2026).
