Success Stories/Immigration/H-1B Specialty Occupation/Extension Changed to an Amendment: One Petition Covered a Job Change and a Status Extension, Approved with No RFE
No RFE

Accountant to financial analyst, approved the first time

Extension Changed to an Amendment

Background

Ms. R earned her bachelor's degree in China, came to the U.S. for a master's in quantitative economics, and worked as an accountant at a sporting goods manufacturer. She started out filing an H-1B extension, then her employer told her she would be moving into a financial analyst role.

Challenges

  • Moving from accounting to financial analysis is a big jump between job categories, and USCIS could easily question whether the new role truly matched her degree.
  • The employer is a sporting goods manufacturer, not a traditional financial institution. "Why does a manufacturer need a full-time financial analyst?" is exactly where specialty occupation RFEs tend to hit.
  • While reviewing her documents, we also found that the expiration date on her I-94 was clearly earlier than the expiration date on her previous H-1B approval notice.

Strategy

  • First we changed the plan, advising Ms. R to switch from an H-1B extension to an H-1B amendment, so one petition would cover the job change and extend her status, instead of two separate filings.
  • Next we tied her degree to the new duties, mapping the core content of her master's program to each specific duty of the new role so that the "degree match" could be checked item by item.
  • Then we explained why the employer needed the position, from several angles, showing it was a real business need and not a job created for her.
  • At the same time we requested a reissued I-94 to correct the wrong expiration date and avoid problems in her status record.

Closing Note

One change of plan solved both the job change and the status extension. Going from accountant to financial analyst is not just a new title; it is a career move that needs a full legal argument. Without premium processing, the case was decided in about two months and approved the first time with no RFE.

Outcome

Approved with no RFE in about two months without premium processing, covering the job change and the status extension in one petition.
