Background
Ms. H majored in mathematics as an undergraduate and earned a master's in media management. After graduating on F-1 status, she worked in the U.S. on OPT for a livestream e-commerce company, doing market research and data analysis. After her H-1B registration was selected this year, she retained us for the F-1 to H-1B change of status.
Challenges
- Specialty occupation: we had to show the position requires a bachelor's degree or higher in a specific field to meet USCIS's "specialty occupation" standard.
- Cross-field background: a math undergraduate degree and a media management master's do not obviously map to a market analysis role, so the connection had to be argued point by point.
- Status continuity: her OPT expired in late June and the STEM OPT extension was still pending, so her status had to stay unbroken at filing and throughout the wait.
Strategy
- We matched the position to the "Market Research Analysts and Marketing Specialists" category on the LCA, cited the official occupational handbook and mainstream job postings on degree requirements, and paired this with an employer support letter explaining the complexity of the duties and their necessity to the company's core business.
- We mapped the core coursework from both degrees to each job duty, then tied in her six-plus years of related work experience to show she fully meets the requirements.
- We untangled how OPT, the STEM OPT extension and cap-gap fit together, and showed in the petition letter that her status remained valid throughout.

Closing Note
A cross-disciplinary degree does not mean an H-1B is hard to win. What matters is explaining the role's specialized nature and the applicant's qualifications clearly and solidly. Ms. H's case was approved the first time with zero requests for evidence, completing her F-1 to H-1B change of status smoothly.
Outcome
Approved September 15, 2026 with no RFE.
