Finance role at an e-commerce company, no RFE
Background
Mr. L holds a bachelor's degree in finance and an MBA. He works as a senior financial analyst for an e-commerce company, working remotely from another state.
Challenges
- Industry and role mismatch: the company's core business is e-commerce and livestream sales, so a finance role invites questions about whether it is necessary and whether it qualifies as a "specialty occupation."
- Degree requirement: an MBA is a general management degree, so we had to show it meets the H-1B requirement of a degree in a specific specialty.
- Cross-state remote work plus a Level III wage: the company is in California and the employee works in another state, so the filing had to reflect the actual work location, and the Level III wage needed experience and management duties to back it up.
Strategy
- We tied the role to the company's business to show why it is needed, and cited the Occupational Outlook Handbook (OOH) and job-board data to show the role is a specialty occupation.
- We mapped his MBA coursework to the job duties item by item and added his more than ten years of financial analysis experience to establish his qualifications.
- We filed the LCA for his actual remote work location and supported the Level III wage with his experience and his responsibility for leading the finance team.

Closing Note
A finance role in a non-traditional industry, a general MBA and cross-state remote work do not make an H-1B hard to approve. What matters is explaining clearly and thoroughly why the role is needed and why the applicant qualifies. Congratulations to Mr. L on an approval on the first try with no RFE!
