Success Stories/Immigration/H-1B Specialty Occupation/Fashion Designer: H-1B Approved on the First Try With No RFE
Creative role approved on the first try

Fashion Designer

Background

Ms. X holds a bachelor's degree in fashion and had just finished a master's in fashion marketing. She works as an apparel designer for a women's clothing brand.

Challenges

  • A creative role: fashion design leans on creativity, so we had to show it is a specialty occupation and not a job anyone with experience could do.
  • No diploma yet: she had completed her master's coursework, but the school had not yet issued her degree, and the H-1B filing deadline was close.

Strategy

  • Showing the role is a specialty occupation: drawing on the Occupational Outlook Handbook and job-board data, and on core duties such as design development, pattern fitting and trend research, we showed the role requires a degree in a related field.
  • File first, supplement later: we mapped her fashion bachelor's coursework to the job duties item by item to establish her qualifications, attached the school's letter confirming she had completed the program, and filed before the deadline. As soon as the degree arrived, we uploaded it through her USCIS online account.

Closing Note

Creative roles can be specialty occupations. When the duties line up with what the applicant studied, a role like fashion design can show the required degree fit just as well.
