Success Stories/Immigration/O-1 Extraordinary Ability Visa/Actor: Approved Without Premium Processing, Visitor Visa Extension Bridging to O-1
Approved without premium processing

Visitor visa extension bridged to O-1

Actor

Background

He was a boxer early in his career and later became an actor. Because of his ethnic naming customs, his passport lists only a given name and no surname, so his I-94 record was entered incorrectly by customs when he arrived on a visitor visa, leaving a status continuity problem.

Challenges

Documentation of his boxing honors from earlier years was largely missing, so the evidence was insufficient for an athlete-based petition. At the same time, we had to manage the status risk caused by the incorrect entry record.

Strategy

We set aside the athlete pathway, where the records were incomplete, and instead focused on his box office performance and character work in martial arts films, filing as an actor. In parallel, we extended his visitor visa to allow enough time for the O-1 to be adjudicated.

Outcome

With no RFE and no premium processing, he transitioned status during his visitor visa extension, and the O-1 was approved within normal processing times.
