Success Stories/Immigration/O-1 Extraordinary Ability Visa/Film and TV Producer: Approved After Two RFEs
After two RFEs

Approved

Film and TV Producer

Background

A producer active on international film and TV projects. In the first RFE, USCIS questioned the prestige of the projects he had worked on. After that response was accepted, USCIS issued a second RFE, this time asking whether projects he joined as a student counted as unauthorized employment, and why a single project had multiple producers.

Challenges

A rare second RFE, involving in-depth scrutiny on several levels: project recognition, lawful status, and cross-checking of timelines.

Strategy

For the first RFE, we added proof of international film festival awards, coverage in authoritative film and TV media, and recommendation letters from industry experts. For the second, we explained point by point that his artistic work as a student was not commercial employment, and showed that dividing duties among multiple producers is common practice in the industry.

Outcome

Both RFEs were resolved, and the O-1 was ultimately approved.
