Second filing approved without RFE
Background
A core technical professional with a strong academic background whose field closely matched the O-1A extraordinary ability standard. The first petition was filed in a rush as OPT was about to expire and received an RFE. USCIS accepted the academic contributions and peer review, but strictly challenged three criteria: original contributions, media coverage, and high salary. The first petition was denied.
Challenges
The hardest thing to prove was whether the original contributions had industry-wide and international impact. With status about to expire, a second filing could only be activated from abroad, so timing and risk had to be managed throughout.
Strategy
We reorganized the client's core first-author papers and cited authoritative databases showing their impact ranked in the top 1% of the field, strengthening originality across quantity, quality, and citations. We folded the arguments developed during the RFE stage into the second filing and tracked the delivery of materials at every step.
Outcome
The second filing was approved with no RFE; USCIS issued its approval just 9 days after receiving the materials.
