O-1 visa despite a pending U visa
Background
Ms. W had been in the U.S. on an F-1 student visa. After her O-1B petition for extraordinary ability in the arts, handled by Lingtu, was approved, she needed to interview for the O-1 visa at a consulate in China. At the same time, she had a pending U visa application.
Challenges
- Sensitive issues piled up: with a pending U visa and an interrupted F-1 program, the officer was likely to ask about her immigration plans, how she maintained F-1 status and whether she worked, and whether her stay in the U.S. was lawful.

- Honest handling of sensitive issues: she did not avoid the U visa application, answered truthfully, and carried the receipt with her to show if asked.
- Guidance on following up: once in administrative processing, we guided her in following up with the consulate to move the case along.
- Fast document submission: when the request came, we quickly turned the 800-plus-page O-1 petition into files that met the consulate's upload requirements, and the visa was approved the same day they were submitted.
