A sensitive fact became a strength
Background
Shortly after entering the United States on an F-1, Ms. C transferred to a school with lower requirements. A month after enrolling she gave birth, did not return to class afterward, and her student status was terminated.
Challenges
Several law firms she consulted earlier had advised her not to mention the birth to USCIS, fearing it would deepen concerns about immigrant intent.
Strategy
Based on experience with similar cases, we judged that in these special circumstances a candid explanation would actually be more persuasive, and submitted the materials truthfully.
Outcome
F-1 reinstatement approved with no RFE (filed 08/21/2024 · approved 12/09/2024).
