Fast approval after RFE
Background
Mr. D's H-1B grace period was running out, and his new employer's transfer could not be filed in time. After our assessment, we filed a change to B-2 status to bridge the gap temporarily.
Challenges
Review of B-2 as a bridge status has become stricter, and it can easily be questioned as merely "waiting for status" rather than genuine visitor intent. The client also had future PERM plans, so the RFE response could not create problems for later immigration filings.
Strategy
Starting from the regulatory requirements for B-2, we argued the reasonableness of his temporary stay and strengthened the evidence of his visit purpose, source of funds, and ties abroad. We handled statements about his future immigration plans with care and responded precisely to each item in the RFE.
Outcome
Approved just 4 days after the RFE response (filed 11/27/2025 · RFE received 06/24/2026 · approved 07/27/2026).
