Six-Year H-1B Limit Reached

Background

The client's six-year H-1B limit was about to run out, but the I-140 had not yet been approved, so the H-1B could not be extended. The employer wanted to keep the client and minimize any gap in work.

Challenges

The change to F-1 had to be completed before the H-1B expired, and lawful work authorization restored as quickly as possible.

Strategy

We filed the H-1B to F-1 change with premium processing and responded to the RFE promptly. Once the change was approved, the client immediately used Day-1 CPT to return to full-time work.

Outcome

Approved (filed 1/17 · premium processing 3/24 · approved 4/1, with work authorized through 4/20 · Day-1 CPT started early May).
