Background
Ms. T's spouse is a green card holder. After the family-based petition was filed, it was subject to a backlog, so she extended her visitor status and then changed to student status to remain lawfully in the United States during the wait.
Challenges
Both I-539 applications had to address the sensitive question of whether an immigrant petition had been filed, and the answers had to be careful and consistent.
