Ms. Z had previously been approved for an O-1 visa for individuals of extraordinary ability through Lingtu, and later received approval of her NIW immigrant petition (I-140). While her O-1 was still valid, she decided to go back to school. Her scheduled O-1 visa interview was canceled at short notice, and she instead interviewed for an F-1 student visa at a consulate in China.

• Immigrant intent at its most obvious: F-1 is a nonimmigrant visa, and consular officers presume that applicants have immigrant intent, so applicants must prove they will leave the United States after completing their studies. Ms. Z already had an approved I-140 immigrant petition, the most direct evidence of immigrant intent there is.
• A status history that is hard to explain: going back from an O-1 work visa to a student visa, the officer was sure to ask, "Your career is already established, so why go back to school?" and "You have already applied to immigrate, so why apply for a student visa?"
• Ties to China had to be proven again: after years of working in the United States, she needed fresh evidence of her connections to family and assets in China.

• No hiding the immigrant petition: she truthfully disclosed her NIW and O-1 applications and presented "adjusting her career plans, studying first and then building her career" as one consistent narrative, leaving the officer with no impression of concealment.
• Reframing her academic motivation: starting from her actual work experience, we explained why she was studying now, what she was studying, and how she would build her career back in China after graduating.
• A bilingual binder of home-country ties: household registration and family members, social insurance in China, and insurance and investment assets were organized item by item.
• Systematic interview training: before the interview, we trained her systematically, rehearsing every question she might be asked. For high-risk questions such as "Do you still plan to immigrate?" and "Why go back to school when you already have a career?" we prepared key talking points one by one and practiced them repeatedly.

An approved I-140 does not mean an F-1 will be refused. If the story behind the change in status is told clearly and consistently, and backed by solid evidence of home-country ties, a student visa can be granted even when immigrant intent is obvious.
