Biometrics Notice Arrived Too Late

Background

Mr. Y was in F-1 student status. After graduating, within his 60-day grace period, he applied to change to H-4 status as the spouse of an H-1B worker and applied for an H-4 work permit at the same time, hoping to get work authorization as soon as possible.

Challenges

  • USCIS scheduled a biometrics appointment, but by the time the notice arrived the appointment date had already passed, so Mr. Y could not attend.
  • Under USCIS rules, missing biometrics can lead to an application being treated as abandoned, with a real risk of denial.
  • Rescheduling biometrics is slow; in some areas the wait is more than 90 days, which would keep delaying both the change of status and the work permit.

Strategy

  • As soon as we learned what happened, we contacted USCIS, explained that the applicant had not received the notice in time, and asked for a new appointment.
  • We kept following USCIS's response and the case status to confirm that the request had been accepted and the appointment would be rescheduled, rather than the case being treated as abandoned.
  • When the new notice arrived, we told Mr. Y right away so he could attend on time and not miss it again.

May 13, 2026 USCIS mailed the biometrics notice for a June 5 appointment, which had passed by the time it arrived
July 13, 2026 We contacted USCIS to request a new biometrics appointment
July 29, 2026 USCIS confirmed in writing that the appointment would be rescheduled
Late September to early October 2026 New biometrics notices received
Mid-October 2026 Biometrics completed
October 27, 2026 Change to H-4 status and H-4 work permit approved the same day

Closing Note

Missing a biometrics appointment does not mean the application is lost. USCIS usually does not deny a case right away for this. What matters is spotting the problem quickly, contacting USCIS the right way, keeping a written record, and following through. Shortly after Mr. Y completed biometrics, his H-4 status and work permit were both approved on the same day.

Outcome

Change to H-4 status and H-4 work permit approved the same day, October 27, 2026.
