Consular Interview Case Results

The client, Mr. Z, held an L-1 visa and was working in the U.S. After returning home, he went to the consulate for his visa interview. On the day of the interview he was told the case needed additional administrative processing (a "Check"), putting the case on hold.

Administrative processing has no fixed timeline, leaving the client in prolonged uncertainty about his status and unable to plan his return to the U.S. Staying on top of the case with the consulate throughout the wait, so it wouldn't get forgotten, was the main challenge over those six months.

Before the interview, we ran a full mock interview to anticipate questions the officer might ask. Once the case was flagged for Check, our team kept up ongoing communication with the consulate, tracked the case status regularly, and kept the client updated to ease the anxiety of waiting.

After nearly six months of waiting, Mr. Z's L-1 visa was ultimately approved and issued.

The client worked in a marketing role at a media company — a position type frequently questioned for lacking “specialty occupation” status in H-1B cases. The case went through consular processing (CP) activation, timed ahead of a new policy change, which meant the consular interview itself was the final gate to clearing the case.

The core issue was the marketing role's professional fit — immigration officers often assume such positions don't require a specific academic background. Since this was consular activation, how the interview went would directly determine whether the case cleared its last step.

We focused on the client's distinctive skill set in marketing, tying specific job duties and data-analysis capabilities to the position to show it genuinely required a specialized background, and made sure the client could explain this clearly at the interview.

The H-1B petition was approved without issue, and the consular visa interview cleared smoothly — no RFE, no additional review.

Mr. Z originally entered the U.S. on a tourist visa and was deported after being flagged for suspected unauthorized work at the border. He was later refused a student visa three times, leaving him with a complicated visa history. He came to us hoping an O-1 visa could help him move past this record and secure a stable, lawful work status.

Two issues stood out. First, his history — a deportation plus three visa refusals — meant the consular interview was almost certain to draw extra scrutiny. Second, the sponsoring company was one he had founded himself and held full ownership of, a self-petition-style structure that immigration officers often question for lack of independent operation.

We restructured the company's ownership to establish clearer independent operations and reduce the appearance of self-employment. For his complicated visa history, we prepared layered, targeted explanatory materials. Before the interview, we ran him through multiple rounds of mock interviews tailored to his refusal history and the nature of his company, rehearsing likely questions and answers in detail.

The O-1 visa was approved at the consulate. Despite the deportation and three prior refusals, and questions about self-employment, Mr. Z passed administrative review and received his visa, allowing him to continue his AI venture in the U.S.

Mr. H's EB-1A petition had already been approved when he attended his immigrant visa interview at the U.S. Consulate General in Guangzhou. Many clients assume USCIS approval is the finish line, but the consular interview is the critical last step.

The interview preparation was unfamiliar and detailed — from reviewing documents to rehearsing the process — since Mr. H had never gone through an immigrant visa interview before, and any overlooked detail could have delayed things.

After the EB-1A approval, we stayed in touch, answered his questions, and coached him on interview preparation, including details like activating his account information ahead of time, so he felt fully prepared.

The interview was approved on the first attempt. The consular officer indicated the visa would be issued within 2–3 weeks, with entry to the U.S. expected around September–October. Right after the interview, we provided him with our U.S. immigration entry guide to help him make a smooth landing.

Mr. L's EB-1A (Extraordinary Ability) petition was approved, and he then attended his immigrant visa (E11) interview at the U.S. Consulate General in Guangzhou. For many EB-1A clients, the Guangzhou consular interview is the hardest part of the whole process — beyond paperwork, issues like disclosing Communist Party membership or a flagged medical exam result can stall the entire case if handled poorly.

Three issues needed to be resolved before the interview: how to lawfully and accurately disclose Party membership with supporting documentation; a medical exam result that could trigger additional scrutiny and needed to be assessed in advance; and the fact that Mr. L had never been through an immigrant visa interview before, a completely different process from a nonimmigrant visa interview.

We stayed engaged from the day of approval through the interview. We mapped out a compliant disclosure approach for Party membership and helped prepare the supporting explanation; we reviewed the medical exam results in advance to anticipate what additional documentation might be requested; and we coached him through the entire interview process, from organizing documents to rehearsing the interview itself.

The interview was approved. Mr. L later entered the U.S. and received his green card.
