Duplicate Approval Notice Obtained via I-824

Approval Arrived Before the Expedite Reply

Background

Ms. Z first came to the United States on a J-1, later lived in China for two years to satisfy the home residency requirement, and was granted an I-612 waiver. She then received an H-1B job offer from a major U.S. tech company. At her visa interview back home, the consulate asked for the official I-612 approval notice, but the paper notice had been lost in the mail. Her visa was held in administrative processing (221(g)) and she could not return to start work. Ms. Z tried every public channel on the USCIS website and still could not get the approval notice, and the consulate firmly insisted on the official notice only. That is when she came to us.

Challenges

  • Time pressure: without the approval notice she could not finish her visa interview and return to work, and the job could be lost at any moment.
  • The consulate would accept only the official USCIS approval notice: the State Department recommendation letter she had submitted was treated as non-final, and a verbal confirmation of approval by phone did not count as proof.
  • The I-824 has no official expedite track: premium processing is not available, and regular processing often takes months.

Strategy

  • With every public channel exhausted, we filed an I-824 to have the official approval notice reissued, which addressed the consulate's requirement at its root.
  • We prepared an expedite request together with the I-824, explaining the urgent risk to her job, so the expedite reasons went into review with the case from day one instead of being added later.
  • After USCIS received the case, our firm followed up on the expedite request and kept the case moving.

Case Timeline

Date Milestone
08/25/2026 USCIS received the I-824
09/15/2026 Our firm followed up on the expedite; USCIS replied that the request had been sent to the service center, with about a 30-day wait
09/22/2026 Client received the approval notice, less than a month after receipt

Closing Note

The approval notice arrived before the formal reply to the expedite request, which shows the expedite materials were working alongside the case from the day it was filed. For applications with no official expedite track, preparing early and pushing actively is what real "expediting" looks like.

Outcome

I-824 approved less than a month after USCIS received it, and the official I-612 waiver approval notice was reissued.
