Background
Y's initial petition was filed by a very small company (only two employees), and Y chose consular processing to activate the H-1B abroad.
Challenges
A small employer can easily raise questions about whether the employment relationship is genuine, and a visa interview abroad also carries uncertainty.
Strategy
We provided one-on-one mock interview training in advance to help Y pass the interview. At the transfer stage, anticipating the risk of a fee increase, the employer chose to cover the premium processing fee so the petition could be filed before the new fees took effect.
Outcome
The H-1B was activated abroad, and the transfer was approved quickly with no RFE.
