Success Stories/Immigration/L-1 Intracompany Transfer/L-1A to EB-1C: Head of a Cross-Border E-Commerce Company
EB-1C approved

Smooth transition from L-1A

L-1A to EB-1C

Background

The client previously entered the United States in L-1A status as head of operations for the U.S. company. After a period of operation, the U.S. company's business kept growing, and its team and business systems had become stable.

Challenges

The focus of the petition shifted from the client's personal history to proving the qualifying relationship between the Chinese and U.S. companies, the U.S. company's actual operating scale and organizational structure, and whether the client continued to perform managerial or executive duties in the United States.

Strategy

We compiled the company structure, staffing, and the client's management responsibilities to show that the U.S. company had a stable operating foundation and that the client's role had evolved from head of a new company to executive of an established one.

Outcome

EB-1C (I-140) approved.
