Another H-1B Layoff

Background

The client was laid off by the H-1B employer, had only one month of pay stubs and limited proof of employment, and filed to change from H-1B to B-2.

Challenges

With thin materials (just one month of pay stubs), we had to show that the change was reasonable.

Strategy

We filed based on the rule allowing a B-2 stay of up to 6 months from the date employment ended.

Outcome

Approved quickly with no RFE, giving the client about 4 more months to look for work than the 60-day grace period would have allowed (filed 01/09/2025 · approved 03/18/2025).
